Washington, DC – On Wednesday, a federal appeals court ordered that the case against Michael Flynn must be immediately dismissed. Flynn was a former national security advisor to President Trump and was charged with lying to FBI agents during an investigation. The three judge panel denied U.S. District Judge Emmet Sullivan the authority to investigate the motion by the Department of Justice to dismiss the case.
In the written opinion, the appeals court said, “The contemplated proceedings would likely require the Executive to reveal the internal deliberative process behind its exercise of prosecutorial discretion, interfering with the Article II charging authority.”
Trump and Flynn supporters have argued that Flynn was set up by Democrats and internal operatives as part of a larger plan to undermine the Trump administration. President Trump celebrated the appeals court decision after the news was released.

The case can still be appealed to the larger appeals panel and potentially the Supreme Court. No announcement has been made as of the time of this writing as to what the intentions are.
