The Denver school district is being sued for discriminating against conservative viewpoints by promoting LGBT flags in schools but banning flags representing other ideas, such as a “straight pride” flag.
Nathan Feldman, the father of two children attending classes in the district, is accusing the school of violating First and 14th Amendment rights, and is seeking $3 million for the “irreparable harm” the discrimination has inflicted, according to a report from a CBS affiliate.
The claim also cites the rights he and his children have “to be free from discrimination on the basis of her viewpoint and his membership in one or more protected classes, including the protected class of sex.”
He charges that his children, attending Slavens School, are banned from exercising their freedom of speech.
Feldman had raised the challenge to the school about why LGBT pride flags were being displayed beside the doors of his children’s classrooms.
He said they “not inclusive of all Slavens School students and only represent one viewpoint on the topic of sex,” the report explained.
Then he asked if similar flags, but carrying the “straight pride” message instead of the LGBT ideology, could be displayed in like manner.
According to the claim, the school principal told him about district policy endorsing “the right of its employees to put rainbow flags or other signs of support for LGBTQIA+ students and staff.”
But the principal also informed him the district “doesn’t allow for other flags,” the report said.
The case names as defendants Supt. Alex Marrero, principal Kurt Siebold and other faculty members.
Responding to the affiliate, the district said it hadn’t been served and couldn’t comment, but a former DPS school board member, Auon’tai Anderson, released a lengthy statement about the benefits of promoting the LGBT symbol.
“As the outgoing vice president of the Denver School Board, I stand firm in our unwavering support for our LGBTQIA+ students, staff, and community members. The recent federal lawsuit challenging the display of pride flags in our classrooms is not only a departure from the values we hold dear in Denver Public Schools but also appears to be a disheartening deviation from the real issues at hand,” Anderson claimed.
Anderson claimed the presence of other viewpoints “has never been a significant concern within our community until now.”
