Charlotte, NC — Earlier this week, we learned that Texas filed a lawsuit against four battleground states due to their actions in the 2020 election. Texas AG Ken Paxton said that actions by Georgia, Pennsylvania, Michigan, and Wisconsin directly harmed Texans due to the election outcome. The case was filed to the Supreme Court.
Since the official filing, eighteen other states have come out in support of the lawsuit. Each of these states agrees with Texas that changes to laws that affected the election were unconstitutional and that their citizens suffered because of it. While many of the states filed briefs to simply be voices, several states joined Texas to argue the case before the Supreme Court.
The four battleground states were given until 3 PM on Thursday to respond to the suit, to which they responded that the allegations by Texas and the Trump campaign were sedition. Each state had strong words in what CNN called a “blistering rebuke” of Texas. Far from blistering, the response was what was expected.
Now, we wait. The Supreme Court has yet to announce if it will hear the case. It is unclear if five justices will support hearing the case, but we do have some expectations either way.
If the court chooses not to hear the case, Trump will continue his legal case through state courts. While the cases are slow to develop, they will continue through the process.
The mainstream media will continue to declare Joe Biden the winner and will say this is the final straw for President Trump. Would President Trump stop the fight if the Supreme Court declines the case? That seems unlikely.
The real interesting thing will be if the Supreme Court decides to hear the case. While the mainstream media declares there is no precedent for the Supreme Court to intervene, they regularly intervene when disputes between states cannot be settled in state courts. This is the exact place the accusations from these states should be heard.
President Trump has asked that Sen. Ted Cruz argue the case before the Supreme Court if the court takes up the case. Cruz retweeted the story and seemed to be supportive of the case. Having Cruz on his side is a big win for President Trump.
If the court hears the case, the mainstream media and the left will not let it go. They will continue to argue that the “Trump stacked” Supreme Court has betrayed the American people. Instead, it seems that the Supreme Court would be trying to protect the American people by hearing the case.
The left has called the lawsuit a longshot, but it really boils down to whether the Supreme Court hears the case. If the court hears the case, it has a significant chance to change the election. Remember, this case is not about voter fraud at all.
Previous legal cases have all revolved around voter fraud, which has been difficult to progress through the legal system. This case involves law changes that allowed votes to be counted that should not have counted. That is a much easier case to argue.
If the Supreme Court takes up the case, it absolutely has the potential to change the election. Now, we simply sit and wait to hear if the highest court will do its job and allow these 19 states and the Trump campaign to submit their arguments.
